
Understanding the Nigerian Building Approvals Process

Obtaining the necessary approvals to develop property in Nigeria is one of the most time-consuming and administratively complex aspects of the development process. For first-time developers — and particularly for diaspora investors unfamiliar with local regulatory frameworks — the process can appear opaque and unpredictable. Understanding the key stages and requirements significantly reduces delays and costs.
The first requirement is a valid land title. In most states, this means a Certificate of Occupancy (C of O) issued by the State Governor under the Land Use Act, or a Governor's Consent where the land has been previously alienated. Without a C of O or its equivalent, development approval cannot be obtained and the land remains at risk of adverse claims. Your professional team should verify the status of any title before purchase.
Planning approval is obtained from the State Urban and Regional Planning Authority — in Lagos, this is the Lagos State Physical Planning and Development Authority (LASPPDA); in Abuja, the Federal Capital Development Authority (FCDA) handles approvals. Applications require a full set of architectural drawings prepared by a registered architect, structural drawings by a registered engineer, and supporting documentation including the land title, tax clearance certificates, and evidence of payment of relevant fees.
Beyond planning approval, building projects require a Building Plan Approval (BPA) and, upon completion, a Certificate of Completion and Fitness for Habitation. For commercial projects, additional environmental impact assessments may be required under NESREA regulations.
